Terms and Conditions

1 – Overview

By visiting our site or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants or contributors of content.

If you do not agree to all the terms and conditions of this agreement, then you should not access the website or buy any products.

 Any new features or tools which are added to the current store shall also be subject to these Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2 – New Customers

To place an order on our site you must be over 18 years of age (or have parental consent), delivery address in the UK or Ireland, and have a credit or debit card acceptable to us in your name.

When you register you will be asked to create a username and password. You must treat your username and password as confidential and should not disclose it to any third party. You will be responsible for all activities and orders made under your password and username. If you think that someone else may either know or be using your username and password, please contact us immediately.

We reserve the right to decline a new customer registration or to suspend or disable your Account at any time and at our sole discretion.

2 – Contract

Once you have placed an order on the site, we will send you an order acknowledgement by email setting out what you have ordered, the price and delivery address. This is a legally binding contract with you, but you will only take ownership once we have completed delivery of the goods to you.

3 – Price and Delivery Charges

The price of the goods you order will be the price on the site at the time you place your order. If a new price or promotion is in place after you have placed your order, these prices and promotions will not be applied to your order. The prices stated on the website will be inclusive of any VAT payable.

Our hand-crafted chocolates are sold by quantity. There is an approximate weight with each quantity. This is continually monitored against average batch weights, but the weight is only for guidance.

We accept payment by all major credit cards. All orders are credit card sanctioned prior to despatch, so please ensure that the details you provide us with are correct. Failure to supply the correct details will result in your order being held pending the supply of the correct details. We cannot accept responsibility for an order being held as a result of the wrong payment details being given.

You agree to compensate us in full against all reasonable costs expenses and outgoings incurred by us in obtaining payments from you in the event a failed payment occurs. This may include an administration charge. 

In addition to the price, a delivery charge will also be payable by you. Delivery is by third party and we charge for the delivery according to charges set out in our Shipping & delivery page.

4 – Chocolate Products

All our products are sourced responsibly. Unless otherwise stated they will contain nuts and dairy products. The ingredients can be seen on the detailed description of ingredients for each product. If you are in any doubt or think you have a nut or dairy allergy, then these Chocs are unfortunately not for you.

These are artisan chocolate products and so should be treated accordingly. You are responsible for them from delivery, and you must store them in the manner appropriate to hand-crafted chocolate. Low or high temperatures and extended exposure to sunlight may cause the product to change (such as melting) and not be at its finest. In these cases, no liability can be accepted by Chocs with Love for faulty goods. There is a limited shelf life for each product. Our recommendation is approximately three months, but please refer to the label on each product.

5 – Personal messages

You can choose a card type for your special message, but these are fixed options and cannot be changed. 

These gifts are about spreading some love and good wishes so we reserve the right not to add the personal message if it is deemed not very nice, rude, spiteful or likely to offend.

In this case the chocs will be sent with no message.

6 – Damaged or Faulty Goods

When your items are delivered please promptly check that the order has not been damaged in transit. If your order is visibly damaged or in any way does not meet our usual high standards, please contact us and we will arrange with you for the goods to be returned to us. On receipt of the goods, we will promptly and fully refund the price of any goods that do not meet with your reasonable satisfaction or arrange for the delivery of replacement goods.

Please retain the original packaging where possible. The goods must be returned to us in the same condition as they were delivered to you, on the day that we send you the return label.

Please remember these chocolates are fragile, date sensitive products and so items cannot be returned if not faulty.

7 – Refunds

If you are entitled to return goods under clause 5 we will reimburse any sum received from you (including the cost of the standard delivery charge where all items in the delivery are damaged), by crediting the card you paid with.

We shall not refund the difference between the standard delivery charge and any premium delivery charge you have selected when ordering the goods.

We shall not be responsible for any return costs for goods returned unless they are damaged or faulty.

Refunds can take up to 20 days to appear in your bank or credit card account. We will make any refunds within 14 days of agreeing any refund with you.

Your consumer rights and are not affected.

8- Delivery

We use third parties for deliveries. But items will always be despatched the same or next day. We always aim to deliver your goods within the delivery time slot we have agreed with you, but we cannot accept liability if the goods are delivered outside of this time slot.

Ownership of, and risk in, the goods will pass to you once we have delivered your order. Read all information on the product label carefully including information on ingredients as these chocolates will contain nuts and dairy products.

If the delivery address stated on your order is not your home address, we will not be liable for any damage or detriment to the goods caused by their onward delivery to you.

We can only make a delivery to an address within the UK.

9 – What we are not Liable for

Whilst we take every care to deliver your order, we cannot be liable for any indirect or consequential loss or damage or loss of profits or reliance you had in having the goods delivered to you arising out of our supply or failure to supply the goods to you.

Nothing in this agreement shall in any way limit our liability for death or personal injury resulting from our breach of contract, tort or negligence nor limit any legal rights you have as a consumer.

The goods are sold to you on the basis that you are a consumer therefore we will not be liable for any special losses that you might suffer using, re-distributing or reselling the goods as part of a business.

We use a third-party delivery service to deliver your goods. We may not be liable for anything that that third party might do to the goods other than under Clause 5.

10 – Other important terms

From time to time, we may identify errors or omissions or need to make changes so reserve the right to modify the contents of this site at any time, you agree that it is your responsibility to monitor any changes to our site.

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue products without notice.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

Neither party shall be in breach of this agreement nor liable for delay in performing, or failure to perform, any of its obligations under this agreement if such delay or failure result from events, circumstances or causes beyond its reasonable control. In such circumstances the time for performance shall be extended by a period equivalent to the period during which performance of the obligation has been delayed or failed to be performed. If the period of delay or non-performance continues for 1 week, the party not affected may terminate this agreement by giving 2 days’ written notice to the affected party.

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

11 – These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.
